Sales Agreement / Terms and Conditions
IMPORTANT: When you pay your invoice, you are agreeing to these terms of service for your purchase and limitations of warranty.
PRODUCT AND INFORMATION ACCURACY Custom Carolina Hanging Beds, LLC (“CCHB”) strives for accuracy in all aspects of our website. However, due to the nature of custom furniture business, changing product specifications and technical changes, there may be errors or omissions in product descriptions, pricing, and availability. CCHB reserves the right to correct any errors or omissions and to update information at any time without prior notice.
FURNITURE DIMENSIONS All dimensions are approximate as everything is manufactured by hand. Dimension variances up to 2 inches are considered normal and should be expected.
ESTIMATED TIME TO BUILD Estimates are provided to Customer as a convenience based on CCHB past experience in the manufacture of similar products. No representation or guarantee is made that the product will in fact be available or delivered on any specific date.
INITIAL PAYMENT The customer acknowledges that the custom furniture they are ordering will be built to suit to their specifications and that actual damages likely to result from their breach of these Terms of Service would be impracticable or extremely difficult to fix the actual damages on the date of this agreement and would be difficult for CCHB to prove. The parties intend that customer payment of the Non-refundable Deposit (50% of the total order cost) would serve to compensate CCHB for any breach by the customer of their obligations under these Terms of Service, and they do not intend for it to serve as punishment for any such breach by the customer.
CANCELLATION/RETURN POLICY CCHB will allow order cancellations for 48 hours after invoice had been paid and payment has been received. After 48 hours, CCHB WILL NOT accept order cancellations and the non-refundable deposit portion of the payment (50% of the total cost of the order) will not be refunded. This is necessary because of the nature of the order being custom. CCHB does not accept returns on any custom ordered product.
ON SITE MEASURING/CONSULTATION A non-refundable charge of two-hundred fifty dollars ($250) will be assessed for all on site visits for measuring and/or installation/design consultations. While non-refundable, should the customer make a purchase based on the referenced, on site consultation, the applicable $250 fee will be applied to the balance of the order.
DELIVERY TIME Prior to delivery, CCHB will contact customer to collect any remaining balance on the order. CCHB will schedule with the customer a window of time to make the delivery. Due to complicated delivery schedules, CCHB is not able to guarantee a specific delivery time. At the customer’s request, CCHB will contact the customer approximately 1 hour prior to the scheduled delivery.
FURNITURE RELEASE Full and final payment (including sufficient time for personal checks to clear) is required prior to release of furniture for delivery or pickup.
DELIVERY GUIDELINES Prior to Delivery Day: We realize things may happen that require changes to your schedule. Please note we do need 48 hours advanced notice to change a delivery appointment. Note: Please, communicate if you have challenging roads, driveways or other access points that would be difficult for delivery trucks. Be sure to find out any requirements for access to buildings that have specific delivery instructions, such as deliveries allowed only during certain hours, dedicated freight elevators, etc. Delivery Day: Please clear the way! Have a pathway cleared through your home to the room in which the furniture will be placed. Please note delivery team cannot rearrange existing furniture, connect or disconnect electrical equipment, hang mirrors or wall art.
DEFECTIVE ITEMS Upon receiving an order, Customer shall promptly check for shipping damage or other defects. If damage occurred to the shipping and packaging containers (boxes, etc.), Customer should note the damage on the freight bill before signing the freight bill. If damage has occurred to the furniture during shipment, customer must refuse the shipment and immediately notify CCHB staff. Notification to CCHB of hidden damage or problems shall be provided within three (3) business days of receipt. If damage is verified, CCHB will repair, replace, or send new parts at our expense, in our sole and exclusive discretion. If shipping is handled by a third party shipper ("TPS"), the TPS shall be solely responsible for any damages occurring in transit, according to the policies of the TPS. CCHB shall have no liability or responsibility for damage occurring through the acts or omissions of the TPS.
ABANDONMENT CCHB will notify Customer at the time that a purchased item is complete and available for shipment or delivery. In the event that, due to no fault of CCHB, said item is not accepted for delivery by the Customer, the item will be considered abandoned. Any item deemed abandoned for a period of time greater that thirty (30) days will become permanent property of CCHB and subject to disposal by CCHB at it’s sole discretion. In addition, any payment received by CCHB for the purchase and/or manufacture of an abandoned item will be forfeited and shall not be returned to the Customer.
WARRANTY All products sold by CCHB are warranted from manufacturing or material defects for a period of one year after delivery. The customer should inspect the merchandise at the time of delivery. Any damage or defects should be noted, photographed, and reported to CCHB and TPS, if applicable, immediately. CCHB reserves the right to inspect, repair or replace this merchandise at its discretion.
